IBT Pulls Election in North Harrisburg

The election is off at NHS that was planned for tomorrow due to legal complications. Multiple alleged unfair labor practices need to be resolved before a fair election can be held. The charges include intimidation, threats, surveillance and many others. The petition had to be pulled in order to clear up these legal matters.

IBT Pulls Election in North Harrisburg

As you all know by now the election in North Harrisburg (NHS) has been pulled by The International Brotherhood of Teamsters (IBT). This does not mean that NHS is out of the fight.

The reason was because of the many alleged unfair and illegal labor practices that were initiated by Fed Ex management. Employees, especially committee members with letters of protection from the Teamsters labor attorney allegedly, (and I have to use the word allegedly, I know it sucks, we know what they’re like) were harassed and threatened by key members of management. All alleged charges against the loving and caring Fed Ex will be addressed, including threats, intimidation and unlawful surveillance. If Fed Ex loves us so much and cares about our future why do they treat us like this? It’s because we are too stupid to know any better and we need them to take care of us.

Another factor was that local 776 in Harrisburg was in political turmoil between two slates running for officer elections. The committee members at NHS were caught up in the turmoil. This election of officers couldn’t have happened at a worse time for NHS. By the way 2 weeks ago a new slate of officers were elected to Local 776 in Harrisburg, the old was voted out. That my friends is how the Teamsters work. If you don’t like the job your officers are doing you can vote them out.

The decision was then made by the IBT to pull the petition for an election. This by all means is not over. NHS will be back in six months to file a petition for an election again. We will regroup, refocus and enter the fight again. Fed Ex did not chase the union out. The anti union employees did not chase the union out. We chose this path to make sure we come back harder and stronger. It is better to withdraw and live to fight another day than to continue handicapped and die.

In closing I would like to say good job to the committee members at NHS I know you will still carry on the fight. To the rest of us, carry on, fight on, we will not be discouraged, we will not be defeated.

Stand Strong and Stay Strong.

Photo: This flyer was put out in NHS on Monday 10-27. Well I don’t understand why Fed Ex can’t grasp the concept of we don’t want to change the way they operate their system. The system works fine. It was originally set up by American Freightways and Sheridan Garrison. What we want has been discussed, argued, presented in many forms and it’s not to change the way the company operates its freight movement. I guess when you can’t discuss what the real issues are you have to go for the extreme scenarios to again, try to persuade the uninformed with a whole lot of nothing.
If you look in the bottom section of this flyer under the management rights clause, it states; “the right to hire, suspend or discharge for proper causes.” The key term here is PROPER CAUSES, that means they have to have cause to discharge you. Of course they left out the grievance process and how it works in this actual Teamster contract.
Right now, we here in Pennsylvania are under an “AT WILL” state law. That means Fed Ex or any other company in the commonwealth can (and I love this word) discharge you for any reason what-so-ever. They can tell you, “you are wearing the wrong color socks and you are fired.” Would they do that? I don’t know, but they can. Once there is a contract we go from an “AT WILL” state to a “JUST CAUSE” contract. That takes power away from them and shifts it to us with a grievance process. This is what scares them the most, the loss of power.

Let’s have “JUST CAUSE”
