Meal Periods Laws in California ...

Here is the website for the The Dept. of Labor Relations in California "ca.gov". You should all read this site to educate yourself on the laws about "Meal Periods". Arkansas are always trying to push certain rules in California that only apply in their state of Arkansas.
For example; just a few weeks ago dispatch in SBO brought up the issue of start times. If a start time is giving to you the day before and you arrive at that start time and dispatch says they have no work for you. They said that you would only get 2 hours of pay! That's not true in CA. they must pay you 4 hours. I challenge that and the following day they said I was right. Isn't it great to live in a state that is "Labor" friendly?

On a related subject but in Arizona a reliable source informs me that warning letters are being issued to those that utilize the restroom facilities at unauthorized times.Authorized times are before work period begins, breaks or lunch-NO OTHER TIMES.
I haven't seen the letter but I'm sure it would include an,"emergency"clause, and think about it wouldn't the call of nature qualify as an emergency. Not answered it would turn into an embarassment.
I'm certain that all states have laws/rules/statutes that enable people to use restroom facilities WHENEVER they need to.
Hope someone will challenge this situation. At a minimum use the warning letter to wipe something

Democracy is a process where decisions are made by voting, with a majority determining the position of the entire group. Unionization is the perfect example of democracy. It is the organization of workers banding together to achieve common goals, bargaining with the employer on behalf of union members to negotiate a labor contract with management.
Participation in this democratic process is as simple as standing-up and saying yes to unionization; saying yes to a better life for ourselves and our families. This process includes the negotiation of wages, work rules, job classifications, workplace safety, complaint procedures; rules governing employment such as hiring and firing; benefits and pension plans.
Our labor is a commodity, our labor as a group is not expendable, and like all-other commodities the price and the terms are negotiable, a contract is the agreement which will improve our lives tremendously. Those FedEx employees who are still on the fence, worried about job security; without a contract you do not have job security. How secure were the Dockworkers, some with more than twenty years experience. How many full-time Dockworkers are still employed in Southern California?
It is truly sad that a fortune 500 company has issues with bathroom breaks, and workplace safety (forklift accidents and injuries). The corporate need for urgency takes priority over basic safety and the well-being of its employees. The West Virginia coalmines are a great example of leaving your safety, welfare and job security in the hands of company management. Unionized coalmines have safety as its main focus; non-union companies have profits as their main focus (productivity at all cost).

Check out this part.....

If the employer requires the employee to remain at the work site or facility during the meal period, the meal period must be paid. This is true even where the employee is relieved of all work duties during the meal period. Bono Enterprises, In. v. Bradshaw (1995) 32 Cal.App.4th 968.

But of course they submit that each driver or dock worker is free to leave during that time. But who picks up the cost of the time to and from a suitable place to eat? And where can you go to get a hot meal in that time frame from either WHT or SBO?

In response to pack a lunch,
This blog is a forum for open discussion or debate. Your opinion may have some value and is open for discussion. I believe you are suffering from that good-old boy syndrome; it appears that your thoughts are not that deep; people who resort to name-calling have nothing to contribute to the discussion. You should ask your managers to give you your opinion. Remember that song “We don’t need no education”

It's time for all posistions to be paid the same, If The ceo's get 200.00 an hr, so do the opps mgrs and dock workers should too. No need to worry about what job you hold here everyone makes the same pay. Everyone gets the same pension the same health plan the same bonus.

Get proof of this crap and take the story to a newspaper; the public needs to know about this kind of thing. Public outrage is a force that will help create the changes we need. I strongly suggest jumping into the fray and riding the wave of anger over the coal mines as far as possible before we miss out on the boat. . .again.

I know nobody asked for it, but I'm going to give my suggestion anyway:

Everybody take their lunch outside the gate and hold up signs!

THIS COMPANY DOES NOT VALUE MY FAMILY OR YOURS AND THE SONNER WE BECOME TEAMSTERS THE BETTER. SOME PEOPLE WHO SAID WE DON'T NEED A UNION ARE STARTING TO SEE THEIR POSISTION CHANGE AND NEW PEOPLE WORKING BETTER SHIFTS AND START TIMES, NO TEAMSTERS NO SENIORITY THAT'S THE SKINNY. Working four-hour split-shifts (2 hours am/2 hours pm) is an excellent example of the exploitation of our labor here in the United States. And there is culpability, to the extent that while working these shifts we are allowing management to exploit our labor. This also demonstrates that FedEx management has no conscience. This company is flagrantly demonstrating that it can do whatever it wants and get away with because the employees will not protest, and as individual employees we cannot protest. But, as a group our protests will be heard, we must support the union efforts that are underway.
The Unionization of Southern California FedEx Freight Workers, the total numbers going into the Teamster Ranks (in So Cal) will total more than 2,500 workers. That is a bargaining factor. This will establish the rules for our labor.
These service centers will include San Luis Obispo, Fresno, Bakersfield, San Fernando, Oxnard, Los Angeles, Whittier, Gardenia, Anaheim, Irvine, Fontana, San Bernardino, San Diego, and Otay Mesa. Our good neighbor Canada has taken the lead in this transformation; we must make it a domino effect.

MAYBE WHEN THEY MERGE NATIONAL AND FRT AS THE RUMOR GOES THESE EMPLOYEES WILL SEE THE LIGHT OF DAY AS THEY WORK 4 HRS A DAY AND THE NEW FOLKS WORK 5 HRS A DAY. NO TEAMSTERS NO SENIORITY ITS THAT SIMPLE.
