first of all matt there you go opening your mouth before you think. How about this being the last time I tell all of you that I did not write the comments about joe. Are you that blind. I am not afraid of my opinions nor do I hide what I think, so before you open your mouth to me make sure you understand what you are saying. As far as "my buddies" in management, you are so off... just ask around and see when was the last time we agreed on anything. I am no ones puppet, and you, the teamsters, or any part of management will ever pull my strings. I dont know about the pictures being taken of the yes union signs, but i do know of the ones taken of my truck. You say that I should come out of the tunnel.... you say we should stick together..... well all you are doing is putting up a wall. No one has answered any questions. The only thing any of you have done is talk about comments I didnt write, or things you have no clue of. I never said I agree with any management. So what. if you think they are pulling my strings...then explain to me what i am getting out of this. You wanna open your mouth and say things that are not true, explain to me why i would be doing this for management. but make sure you think first. You might say it would be to move up....I had my chance and i choose not to. I didnt like the politics. I am not one to keep my mouth shut and say yes and no sir. Yeah ive been passed up, yeah ive trained a couple of people that are management now.....so tell me what i am getting out of this. You say that you worked for viking for 13 years.....so what did you accompish in those 13 years. What thinggs did you change? The pension is your "big score" to change people. So here is a simple question for you Matt, what happens to that pension if the terminal shuts down, and we at the terminal loose our jobs? I know more then what you think so dont try to bullshit me. You might think im a dumb young kid who is being lead by management, but you are in for one hell of a surprise. hey Matt I had a great time at the meeting down at the local. There will come a day soon when we will be Union and stop the constant harassment from management. Hopefully I will see you next month Mr. Dominguez. keep the comments coming they are right on lets think about our future and organize for better pay, pension, retiree medical, to eliminate favortism, and part timers getting health insurance.

Sorry larry one more thing you need to know,When my brother's company shut down at C.F Sep.1.2002,He still got his pension from the Teamster .But ask a manager from C.F if they got their Company pension?

I just wanted to say I am out of the Whittier facility and I am part time and you guys have really stepped up to the plate pushing fo the union I am pro union and keep up the good work stop the harassment and stop the managers lies.

wow!!! Larry you are calling people names you sound like management harassing people This os what I am saying I hate coming into work with a negative manager telling me stuff or calling me names. This is pure harassment. and you know Larry on this site you can speak your mind even being disrespectful and angry like you are, but we could never speak up at work we would be fired if we told the management we were for the union. They wont even let us talk all the management does is try to construct a list of all employees who want the union and the management sets out to harass them. Grow up Larry

Answers to your Questions:

on the Union Authorization Card--
Q. What is it?
A. As it clearly states, the card authorizes the specified Union to represent you in collective bargaining with management. Under the Railway Labor Act, when at least 35% of the workers nationwide in a given classification [eg., courier, CSA, etc.] sign cards, a mail ballot election for Union representation will be held.
Q. I'm afraid... What if management finds out I signed it?
A. Federal labor law establishes criminal sanctions such as hefty fines and even time in jail for managers who seek out this type of info. Likewise, it is illegal for managers to punish or single out employees who support the Union. The Union will help protect you.
Q. If I sign but change my mind, can I get my card back?
A. Yes. Send your request in writing to both the Union and the governing labor board.
Q. If an election to vote for or against a union is held, does signing the card mean I have already voted "yes, I want the Union?"
A. No! You would still vote your conscience. In fact, if you want the Union, it becomes absolutely essential for you to go out and vote "yes" at election time!



on Union Dues--
Q. Why does a union need to collect dues?
A. Dues money pays the Union's bills, such as staff salaries, organizing expenses, newsletters to keep members informed, etc.
Q. How much are union dues?
A. Dues are typically two hours of your pay per month.
Q. When would I start paying dues?
A. The Union cannot begin collecting dues until the thirty days after FedEx signs a legally binding contract. Dues do not begin when you sign a union authorization card.
Q. Would I as a Union member have any say-so about where my dues money goes?
A. Of Course! Unions typically have voting approval procedures written into national and local constitutions covering items such as dues levels and increases, officer salaries, and other expenses. By contrast, do you as an employee have any voting control over Fred Smith's salary and perks? Do you have any say-so at all about where the revenue of Federal Express goes to? No! And you never will, at least not until the day management signs a legally binding Union contract stipulating what FedEx pays out as your wages and benefits!

MANY FEDEX MANAGERS are starting to re-evaluate their "tactics" regarding anti-union activities. The Railway Labor Act-- the very "law" that Uncle Fred Smith invested millions of dollars to retain-- may cost many managers their life savings, as well as earn them an unpaid vacation in a Federal prison. Intimidation tactics are clearly illegal. Unlike the National Labor Relations Act, the RLA permits managers to be held personally accountable.
Many managers understand that a company willing to turn its back on the very loyal workers who made it successful will not hesitate to throw them to the dogs as well. Plus, managers actually stand to benefit from contractual certainties that will eliminate the headaches of constantly changing, arbitrary gray areas of the so-called "People Manual." Managers may also gain from parallel increases in pay and benefits that hourly workers at FedEx will eventually win under future Teamster contracts.
We invite all Federal Express managers to take a look at how the actual law reads regarding anti-union activities. Please do not jeopardize your career, or your family's financial security and honor, to do the dirty work of upper management. Is it any wonder that some managers are removing themselves from the direct line of fire between unionizing hourly workers and upper management? You can do absolutely, positively nothing to prevent unionization. So stay cool, honor the democratic wishes of your employees, and obey the law.
BE ADVISED. Below are excerpts from the Railway Labor Act. The law is very clear. If you are concerned with the legality of your own actions and comments, you may want to consult with a private attorney, rather than relying on the corporate FedEx legal department.

paragraph four: Organizing and collective bargaining; freedom from interference by carrier; assistance in organizing or maintaining organization by carrier forbidden; deduction of dues from wages forbidden. Employees shall have the right to organize and bargain collectively through representatives of their own choosing. The majority of any craft or class of employees shall have the right to determine who shall be the representative of the craft or class for the purpose of this chapter. No carrier, its officers or agents, shall deny or in any way question the right of its employees to join, organize, or assist in organizing the labor organization of their choice, and it shall be unlawful for any carrier to interfere in any way with the organization of its employees.



paragraph ten: Violations; prosecution and penalties. The willful failure or refusal of any carrier, its officers, or agents to comply with the terms of the third, fourth, fifth, seventh, or eighth paragraph of this section shall be a misdemeanor, and upon conviction thereof the carrier, officer, or agent offending shall be subject to a fine of not less than $1,000.00 nor more than $20,000.00 or imprisonment for not more than six months, or both fine and imprisonment, for each offense, and each day during which such carrier, officer, or agent shall willfully fail or refuse to comply with the terms of the said paragraphs of this section shall constitute a separate offense.

* conduct these union activities on company property in non-work areas [eg., break or lunch room, restroom, parking lot, at your locker]

* display union stickers or pins on our personal property [eg., lunchbox, drink container, purse, briefcase, street clothes] but not on company property







It is illegal for our employer to engage in:



* surveillance of workers who attend union meetings, or any undercover activity which would indicate that employees are being spied on;
* threatening or punishing workers with termination, lay off, cut hours, cut duties, or discipline for union activity;
* granting or promising wage increases, benefit improvements, promotions, improvements in working conditions, or special concessions to keep the union out;
* threatening to or actually closing a facility, or slashing operations to punish union activity;
* questioning employees about union matters, union meetings, union interest, how they intend to vote, or about other employees' feelings towards a union;
* threatening to move the facility or failing to grant a scheduled wage increase because of union activity.



All of these employer acts violate federal labor law--- and your rights as Americans. Stand up for dignity and respect on the job. Document all violations, take the names of witnesses, and report each incident to your fellow FedEx Teamsters and organizers.

A. Managers represent the interests of a small number of wealthy investors, best symbolized at FedEx by C.E.O. Fred Smith. Their "duties" include policing us, pushing to get more work out of each of us, and resisting our attempts to improve wages, benefits, and on-the-job rights. Management systematically schools itself in the infamous art of union busting by means of classes, consultants, and policy manuals. Q. What's "in it" for you FedEx workers who advocate the Union?

Q. Sometimes I think my manager "goes overboard" with what she says about unions. Can management say anything they want to?
A. No! Management cannot violate federal labor law. They are prohibited from making threats, promises, saying that unionization will result in loss of benefits or pensions, etc... Telephone your local Teamsters union to learn about legal restrictions governing management's conduct under the Railway Labor Act.
Q. Okay, I've researched federal labor law. So what should I do when I'm sure my manager's comments are illegal?
A. Ask him to repeat what he said, and then write it down word for word. Calmly and politely tell your manager that you believe he may be breaking federal labor law, and why. Jot down the names of all witnesses, and ask them to likewise document the incident. Discuss it with FedEx union members. Depending upon the frequency, nature, and severity of these occurrences, we may take appropriate legal action. Under the RLA, managers found guilty may be fined or jailed. The Union will help protect you against managerial recriminations, which are also illegal. By standing up for your legal rights, you'll likely see management backing down.

The harassment and total disrespect of Whittier Employees is continuing. Whittier employee/shop steward/teamster organizer Sal Hernandez hurt his back a couple of weeks ago. It was proven he was injured by lifting up a defective ramp. Which was the ramp manufacturer's fault for Sal Hernandez being injured. Sal went home 2 hours after he was hurt. He trying to tough it out for the safety streak at Whittier even working injured not to let his brothers down. Sal went home intending to rest for a couple of days then returning to work. He received a call from his boss telling him to go see the butcher company doctor at the clinic. Sal then reluctantly agreed and went to go see the butcher. The butcher then told Sal that he could return to work under the pretext of light duty. Sal then told the doctor, "But my back hurts how am I supposed to do light duty."
The butcher told him that he (Sal) should be at home resting, but that he (the butcher) had to mark Sal down for light duty because Fedex had instructed the doctor to do so and that was law. Sal then remarked back,"What is that Fedex law????" The doctor remained quiet.This injury was marked down by the butcher as light duty so Fedex wouldn't have to pay workmans compensation to Sal so Sal could stay home. This is done to all Fedex employees even ones that get extremities cut off at work. This is just another ruthless deceptive scam from Fedex management. So Sal reported back to work where he was isolated from other employees put to work in the driver trainer's office away from other employees and under the watchful eyes of the driver trainers. See since Sal is for the union the company tries to watch, intimidate, and harass him even follow him into the bathroom. So Sal is working when the terminal manager brings Sal avocados from his tree at home saying that God was talking to him (the terminal manager) and that God instructed him to give those avocados to Sal. Sal was perplexed by this questioning the sanity of the service center manager because on one hand the service center manager harasses him on the dock calls him names, cusses at him, and on the other hand the service center manager has a conversation with God and God instructs him to bring fruit to Sal. I didn't know the service center manager has a hotline to God, buy anyways, Sal keeps working but informs his operations manager that he needs to take the rest of the week off in order for his back to fully heal. The service center manager and operations manager agree and Sal informs them he needs to use his sick pay for his time off for when he is sick. They agree and Sal takes off for the week. When Sal comes back to work he is informed that his vacation pay was used for his time off and his vacation scheduled for the summer will now have to be cancelled. Sal then confronts the operations manager and the operations manager tells him they never had a converation about Sal using his sick pay and now his vacation is cancelled. Sal becomes terribly disappointed and tells the operations manager that he will talk to the service center manager or the labor board if need be and the operations manager came back with;"Do whatever you have to do I don't care." Sal then said,"Ok." Sal then tried to contact the service center manager who had the day off then he went home and contacted human resources and the representative from human resources told Sal that using the vacation time as a substitute for sick pay is company policy and that he could do nothing about it. Sal then asked why weren't the employees informed of this policy change. Human resources then informed Sal that inquires to human resources were the only way policy changes to the fedex handbook could now be obtained. Sal then resigned himself and depressed at the situation hung up the phone. It is sad a 18 year company man gets treated this way when he becomes injured on the job. I guess you need to be careful and not get hurt cause you could get screwed too.

The latest news hot off the rumor mill press is that Fred Smith has aqired a mass amount of containers. These containers are rumored to be used to transport freight up and down the west coast. More business for Fedex Freight?? Wrong!!!! This is a manipulative plan used to transport freight by boat up and down the west coast which will affect the west coast and all of southern California. These new boat runs will eliminate thousands of runs for our valued line drivers and cancel a lot of hopes and retirement plans for these highly valued line drivers. I hope this destructive plan never takes effect, but who knows what will happen next with this company. Not a secure future with Fedex. Shame on them!!!!!!!!

UNION DUDE.... I wasnt bashing on others, if you would read what is going on then you would know that he was asking me about something i did not write and im tired of answering those questions. No im not management, ask joe rudy or any of the others. I am just a hostler. Eventhough Rudy wwould say, just like the rest of you, that i am a puppet for management. I think all this talk is funny. You should know that you cant be fired for wanting union, so where ever you are getting that information from is wrong. I do not agree with anyone in the company treating anyone of us different for the thoughts we have. Management should not be harassing any of you. If they are they are wrong. I dont mind that my opinions are not the same as yours, but that doesnt make us different, just on different sides. You should not be afraid to speak your rights, but it doesnt mean i agree with you. This is the kinda crap that irritates me. If you knew your writes you wouldnt be worried about management. One side or the other just not threaten or harass the other side. It is your right to speak your opinion. As long as you do it on personal time it cannot affect your job, and if it does, then you have a case to fight and win. I am not doing this for management, I just feel differently then the rest of you. I am not doing this for any other reason but my own. YOU BETTER RECOGNIZE AND ORGANIZE!!!!!!!!!!!!!!!!!!!!!
The deceptive lies at Whittier are continuing. The Whittier employees have been informed that they will not receive a Vpep again this month and speculation abounds for the reason why. Management says the freight volume is low, but questions are still being entertained by the employees. One reason a bonus check might not have been obtained is that Fed Smith needed some extra cash to buy his containers for his cut the line drivers runs program or quite possibly the vpep money was used to paint the facility for the big open house. Also all union boards were covered up when the customers came to the facility. I guess the service center nabager was embarassed on his anti union stance since many of fedex's customers are union companies. Or maybe the service center manager is just embarassed he is harassing his employees in front of the customers?? Also a Barbeque has been given to the employees but I would rather have more money in my pocket we already get the weenie every day anyways so keep the weenies fedex management.

you know the lies are continuing I only get 30 dollars on my vpep only normally if I work a lot sometimes 15 dollars or 10 dollars maybe enough to buy me some big mac meal or some chicken nuggetts. so, it makes perfect sense why we didn't get a vpep. I bet the managers got one figures I just got a kick in the ass for my hard work :( fedex chupa

hey Hoffa, what makes you think im management, h=just ask rudy, joe, or even ray, they all know who i am so dont think im someone who im not. I am "you know who" from the other site. I am an hourly employee and I am just speaking my mind. Does it amaze you that someone other then management would speak out. I know you think that it makes no sense but its true. I am a hostler and i do work hard everyday. Yes i do agree with some things that people have said about changing the company for our benefeit. But i just dont agree with bringing in another party to do our job for us. Dont you think that your voice should be heard from you, dont you wanna change the company and be proud to say its like this because of us? Let me know if you want to change the wrongs in the company and not just hide them with others. Larry

there are a lot of wrongs in our company but I dont trust you and why would I want to trust you who are not for the employees you are with management together harassing putting employees down I see what youre doing I dont want anything to do with you. you are hurting employees who want to secure a better future for themselves and encouraging management to keep harassing us. its just not right and I dont know why you would not think of other people besides yourself I dont care what management has promised you or what supervisor is your best friend this week but you are following the harassment trail bad mouthing Joe Nuno and Rudy taking cheap shots at them you have no moral character and are hurting the future benefits employees that they are working hard to obtain you have a mean heart
